Terms of Service and Conditions

Sera Kim’s Terms of Service (as of August 24th, 2025)

Artwork commissioned from me automatically binds the client to the terms below. Any breach of said terms will result in legal action.

 

*CLIENTS ARE REQUIRED TO PROVIDE A SIGNATURE BEFORE THE START OF A COMMISSION*

 

All terms of service (TOS) below are subject to change at my discretion

 

The artwork I will draw includes:

• Anthropomorphic animals

• Human characters

• Logos

• Fantasy related characters

• Animals

• Still life's (including backgrounds, portraits, etc.)

• Fan art

• NSFW: Specifically, explicit adult content will be charged for an additional 15% fee.

• NSFW: Specifically, violent related content (gore, etc.) will be charged for an additional 15% fee.

• Monsters, fictional animals/creatures

• Tattoo designs (sketches only)

 

The artwork I will not draw includes:

• Lolis or children of any kind in any NSFW Context

• Hate speech and discrimination towards any groups. This includes: racism, homophobia, transphobia, xenophobia, etc.

• Domestic abuse/violence of any nature.

• Fetish work (examples being: vore, feet, inflation, etc.)

• Depictions of self harm and suicide

• Heavily detailed machinery (depends on the artwork requested)

 

Prices of commissions will be determined depending on how much effort and time is required for a drawing. (For example: the face, torso, or full body sketches/designs.)

• Prices are set by myself, the artist, on a case by case basis and are NON-NEGOTIABLE

 

General Terms of Service:

• I reserve the right to refuse any commission for any reason at all. Furthermore, as the artist, I also reserve the right to cancel/refund for any circumstances no questions asked.

• I retain all rights to my artwork, and am free to use it to suit any of my needs. This includes my portfolio, galleries, and self promotions.

• The client has permission to use the artwork for any non-commercial use as long as it is credited towards me, the artist.

  • You cannot claim the artwork as your own.

  • None of the artwork that I have done may be used for commercial use unless specifically agreed upon in advance and discussed prior with me, the artist. (Artwork that will be used commercially is subject to different commercial prices and must be agreed upon prior to—and separately to—commission approval.)

• Tracing, editing, referencing my artwork, removing my signature from my artwork, claiming the artwork as your own, or stealing it in any way is in direct violation of my terms of service and will be pursued with legal action

  • *To Clarify, the industry of referencing if done incorrectly could result in copyright or backlash. Fan Art and Referencing for Commissioning if allowed and even encouraged.*​

 

All prices are in USD (United States Dollar), currency conversion to USD is also a valid form of payment.

 

• Commissions will be accepted through Discord, Twitter direct messages, Instagram direct messages, Ko-fi direct messages, and e-mail.

 

• All information down to the last detail is required to be upfront and prior to the commission. This includes: color scheme, pose, clothing, facial features, expression, etc.

  • Any heavy alterations required due to lack of information by completion of the final draft will require an additional fee.

  • Commissions that require a priority will be charged a fee. This will be a 15% fee towards the commissioned artwork.

 

• Payments are primarily accepted through PayPal Invoices, or Ko-fi as a very last alternative.

  • Payment will be requested upfront through PayPal invoice. Ko-fi may be used as an alternative, but will require an additional fee due as it is considered a last resort." I imagine most people, who have an understanding of the English language, will also find it satisfactory.

  • Other payments that provide USD may be discussed but will most likely be rejected.

  • Payments that are not received within 48 hours will be voided and canceled unless a later, specific time is agreed upon prior.

  • Do NOT send payment without my consent.

  • Down payments are required for half the commission fee, unless explicitly stated otherwise by the artist.

 

• It is YOUR responsibility to notice and keep track of your commission’s progress. I will send multiple updates of the commission (watermarked) and will notify you if anything needs adjustments to your liking. However, I, like anyone else, am subject to human error, so if you’d like to see progress shots please message me as soon as possible.

  • Any alterations needed due to lack of information from the client’s end will be subject to additional fees that reflect the amount of work the alteration requires.

  • Significant alterations stemming from a lack of information given by the client will be subject to additional fees reflecting the amount of work required for said change. This includes anything requested after extensive progress has already been made.

  • Up to 5 minor edits are provided without charge. Any additional edits past the maximum will be subject to additional fees.

 

• I cannot set an exact date of when a commission will be done as I am very busy with other activities in my daily life such as work, university, etc.

 

• Full refunds are non-negotiable once the commission is finished, and only partial refunds are available for any work that is incomplete upon the time the refund is requested.

  • There are absolutely no refunds once I have completed the entire commission as it is the client’s responsibility to inform me of any changes desired prior to the Work in Progress Stages.

 

• Absolutely none of the work is to be used in NFT’s, Blockchains, Cryptocurrencies, etc. For any and all reasons.
